Why takedown requests get rejected
Brands lose counterfeit fights on paperwork, not on merit. A complaint that says a seller is fake gets closed the same day. A complaint carrying a trademark registration number, a test buy order ID, and a side by side photograph gets the offer pulled.
Treat enforcement as a filing discipline. You are not persuading anyone. You are handing a reviewer enough structured proof to act inside a queue that gives your case a few minutes at most.
Separate counterfeit from unauthorised resale
This split decides which lever you pull. A counterfeit is a product carrying your mark that you did not make. An unauthorised reseller is moving your genuine goods without your consent. The second is usually not trademark infringement in India once those units were sold once through your own channel. File a counterfeit claim against a genuine reseller and the report gets rejected, and a pattern of rejected reports slows every filing you make afterwards.
Sort every offender into one bucket before you file:
- Counterfeit or replica stock: intellectual property complaint, test buy required.
- Genuine stock, unauthorised seller: distributor invoice audit and channel terms, not an IP notice.
- Stolen images, copy, or A plus content: copyright and listing authority route.
- Label, MRP, or country of origin gaps: the Legal Metrology route, which platforms enforce separately and faster.
The evidence pack you build once
Assemble one folder per brand and reuse it. Filing should then take about 20 minutes per case.
- Trademark registration number, class, and the certificate from the Indian registry, plus proof of Brand Registry enrolment.
- A control sample of genuine product, photographed on a neutral background, with batch code and packaging visible.
- A test buy from the offending offer: order ID, the invoice showing seller legal name and GSTIN, and dated unboxing photographs.
- A side by side sheet with five or more concrete differences: print registration, font weight, batch code format, seal type, net weight in grams.
- Your authorised distributor invoice trail, so you can show the suspect units never left your own supply chain.
- Dated screenshots of the live offer with the ASIN or FSN and the seller name visible.
Two habits make the folder work. Photograph the genuine control sample in the same lighting and at the same angles every time, so differences read as differences rather than as camera noise. And keep the invoice trail current, because a distributor list that is six months stale is the most common reason a strong case stalls at the second round of questions.
Filing on Amazon India
Brand Registry enrolment comes first. Use Report a Violation inside Brand Registry rather than email or a generic seller ticket. Pick the violation type precisely, submit the offending ASINs in one report, and attach test buy order IDs for counterfeit claims. Clear counterfeit reports backed by a test buy are typically actioned within one to three business days.
Everything you submit lands in the reports dashboard inside Brand Registry. That dashboard is your audit trail, your recidivism log, and the only credible answer when a founder asks what enforcement bought this quarter.
If a report is rejected, do not resubmit the same file. Find the missing element, usually the test buy or a legible mark on the product itself, and refile once. Serialisation and self service takedown programmes are the structural fix once your monthly notice volume sits in double digits.
Filing on Flipkart and escalating
Flipkart handles brand complaints through its intellectual property desk. Send the registration certificate, a signed statement of authority from the rights holder, the listing URLs with their FSNs, and the specific ground. Expect five to seven working days for a first response, and expect to follow up.
When platform routes stall, the statutory ladder is short and useful. Under the Consumer Protection E-Commerce Rules of 2020, every marketplace must publish a grievance officer, acknowledge a complaint within 48 hours, and redress it within one month. The same rules require the marketplace to display each seller legal name and principal address, which hands you a named party for a cease and desist. Under the intermediary rules of 2021, a platform must remove unlawful content within 36 hours of a court order or a government notification. That is why one injunction often moves faster than fifty tickets.
Run it weekly, measure it monthly
Book 45 minutes every week. Search your brand term, your top three misspellings, and your hero product images by reverse image search. Open the 20 cheapest offers on your top 10 ASINs. File what qualifies and log what does not.
Keep one sheet: date, platform, seller name, ASIN or FSN, bucket, evidence attached, outcome, days to action. Review it monthly on four numbers. Share of your top 50 listings under your own control. Median days from filing to removal. Repeat offenders inside 90 days. Test buys spent.
Budget for roughly 20 test buys a quarter. That is the running cost of enforcement, and it is far cheaper than a rating that never recovers after a batch of fakes ships under your name.
